These Terms and Conditions apply to the webshop of Stichting PR 860 Squadron. Through our webshop, we sell, among other things, patches, coins, keychains, clothing, and other squadron-related items.

Please read these Terms and Conditions carefully before placing an order.

Article 2 – Applicability

These Terms and Conditions apply to every offer made by Stichting PR 860 Squadron and to every order placed through our webshop.

By placing an order, you agree to these Terms and Conditions, our Privacy Policy, and our Returns and Refunds Policy.

If one or more provisions of these Terms and Conditions are found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 3 – Our Webshop and Shopify

Our webshop is provided through Shopify. Shopify provides the technical platform that enables us to manage our webshop and process orders.

The purchase agreement is concluded between you and Stichting PR 860 Squadron. Shopify is not a party to the purchase agreement between you and Stichting PR 860 Squadron.

Article 4 – The Offer

We make every effort to describe our products as clearly and completely as possible. This includes, among other things, product photos, dimensions, colours, materials, design, and price.

Colours and details may appear slightly different on a screen than in the actual product. This may be due to screen settings, lighting, or production method.

Obvious mistakes or errors in the offer, such as clear typographical errors or incorrect prices, are not binding on Stichting PR 860 Squadron.

We may modify products, temporarily discontinue products, or remove products from our assortment.

Article 5 – Products

Our webshop sells, among other things, patches, coins, keychains, clothing, and other squadron-related items.

Some items may be available in limited quantities. When a product is sold out, we cannot guarantee that it will become available again.

Products that are specially made or personalised at the customer’s request may, under certain conditions, be excluded from the right of withdrawal. This will be clearly stated with the product or during the ordering process.

Article 6 – Orders

An order is placed once you have completed the ordering process in the webshop and confirmed the order.

After placing an order, you will receive a confirmation by email. Please check this confirmation carefully. If any details are incorrect, please contact us as soon as possible at info@860squadron.nl.

We may refuse or cancel an order if:

  • the product is not available;

  • there is an obvious error in the price or product information;

  • the payment has not been successfully completed;

  • there is a suspicion of misuse, fraud, or unlawful conduct;

  • delivery to the specified address is not reasonably possible.

If we cancel an order after you have already paid, the amount paid will be refunded to you.

Article 7 – Prices and Payment

All prices in our webshop are stated in euros.

Prices include VAT where VAT is applicable, but exclude shipping costs, unless stated otherwise.

Shipping costs are shown during the ordering process before you definitively place your order.

Payment is made through the payment methods offered in our webshop. The order will be processed once the payment has been successfully completed.

We may change prices, promotions, and discounts. For orders already placed, the price stated in the order confirmation applies, unless there is an obvious error.

Article 8 – Delivery and Shipping

We ship orders to the address you provide during the ordering process. You are responsible for entering your address details correctly.

We try to process and ship orders as quickly as possible. If an estimated delivery time is stated, this is an indication only.

Unless otherwise agreed, we will deliver orders no later than 30 days after the order has been placed. If delivery is delayed, we will inform you as soon as possible.

The risk of damage to or loss of the product remains with Stichting PR 860 Squadron until the product has been delivered to you, unless you have chosen a carrier other than the shipping options offered by us.

Article 9 – Right of Withdrawal

As a consumer, you generally have the right to cancel your online purchase within 14 days after receiving the order, without giving any reason.

After cancellation, you have a further 14 days to return the product.

During the withdrawal period, you must handle the product with care. You may inspect the product in the same way as you would be allowed to do in a physical shop.

Where reasonably possible, the product must be returned unused, undamaged, and in its original condition and packaging.

Article 10 – Returns

If you wish to exercise your right of withdrawal, please contact us at info@860squadron.nl.

Please include:

  • your name;

  • your order number;

  • the product you wish to return;

  • optionally, the reason for the return, although you are not obliged to provide one.

The costs of returning the product from your address to our return address are at your own expense, unless we agree otherwise with you in writing.

The risk and burden of proof for the correct and timely return of the product lie with you. We therefore recommend that you package the product properly and retain proof of shipment.

Article 11 – Refunds

If you exercise your right of withdrawal, we will refund the full order amount, including the standard shipping costs of the original order.

If you selected a more expensive shipping method than our standard shipping method, we are not required to refund the additional costs of that more expensive method.

We will refund the amount as soon as possible, but no later than 14 days after you have informed us that you wish to withdraw from the order.

We may withhold the refund until we have received the product back or until you have provided proof that the product has been returned, whichever occurs first.

The refund will be made using the same payment method used for the original order, unless we agree otherwise.

Article 12 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for products that are specially made or personalised for you. This includes, for example, items provided with a specific name, text, numbering, or other personal adjustment at your request.

If the right of withdrawal is excluded for a product, we will clearly state this with the product or during the ordering process.

Article 13 – Exchanges

Exchanges are only possible if we agree to them and if the desired replacement product is available.

Any return and shipping costs related to an exchange are borne by the customer, unless we agree otherwise in writing.

Article 14 – Statutory Warranty

We warrant that our products conform to the agreement, the stated product information, and the reasonable expectations you may have of the product.

If a product is damaged, incorrectly delivered, or defective, please contact us as soon as possible at info@860squadron.nl. Preferably include photos of the issue and state your order number.

The statutory warranty always applies. These Terms and Conditions do not limit your statutory rights as a consumer.

Article 15 – Complaints

If you have a complaint about a product, order, delivery, or our service, please contact us at info@860squadron.nl.

We ask that you describe the complaint as completely as possible and, where applicable, include photos or other relevant information.

We will respond within 14 days of receiving your complaint. If we need more time to assess the complaint, we will inform you within this period.

Article 16 – Accounts

If our webshop offers the option to create an account, you are responsible for entering your details correctly and for keeping your login details secure.

You may not use your account for unlawful activities, misuse of the webshop, or actions that may cause harm to Stichting PR 860 Squadron, other customers, or third parties.

We may block or delete an account in the event of misuse, fraud, or breach of these Terms and Conditions.

Article 17 – Intellectual Property

All texts, photos, designs, logos, images, product names, patch designs, coin designs, and other content in our webshop are the property of Stichting PR 860 Squadron or are used with the permission of the rights holder.

You may not copy, distribute, modify, use for commercial purposes, or otherwise disclose this content without prior written permission.

The purchase of a product does not grant any right to use the underlying designs, logos, trademarks, images, or other intellectual property rights.

Article 18 – Reviews, Photos, and Customer Feedback

If you share a review, photo, or comment with us, for example through the webshop, by email, or via social media, Stichting PR 860 Squadron may use it for customer contact, quality improvement, and, where appropriate, promotional purposes.

We will not use your full name or identifiable personal data for promotional purposes without your consent, unless this information has already been made public by you.

You are responsible for the content you share with us. Such content must not infringe the rights of third parties and must not be unlawful, misleading, offensive, or harmful.

Article 19 – Privacy

We process personal data in accordance with our Privacy Policy.

Article 20 – Links to Other Websites

Our webshop may contain links to third-party websites or services, such as payment providers, carriers, or social media platforms.

Stichting PR 860 Squadron is not responsible for the content, operation, or privacy practices of third-party websites or services. Please consult the terms and privacy policy of the relevant third party.

Article 21 – Prohibited Use

You may not use our webshop for:

  • unlawful purposes;

  • fraud, deception, or misuse;

  • distributing viruses, malware, or harmful software;

  • collecting personal data from others;

  • copying, scraping, or automatically extracting data from the webshop without permission;

  • actions that may disrupt the operation, security, or availability of the webshop;

  • infringing the rights of Stichting PR 860 Squadron, Shopify, or third parties.

In the event of misuse, we may restrict or block access to the webshop.

Article 22 – Force Majeure

Stichting PR 860 Squadron is not liable for delays or failures resulting from circumstances beyond our reasonable control.

This includes, among other things, disruptions at carriers, payment providers, Shopify, internet services, government measures, strikes, fire, natural disasters, or other unforeseen circumstances.

If delivery is temporarily impossible due to force majeure, we will contact you to seek an appropriate solution.

Article 23 – Liability

Stichting PR 860 Squadron is not liable for indirect damage, consequential damage, loss of profit, or damage resulting from improper use of products, to the extent permitted by law.

Our liability is in any event limited to the amount of the relevant order, unless there is intent, deliberate recklessness, or liability that may not be limited by law.

This provision does not limit the statutory rights of consumers.

Article 24 – Changes to These Terms and Conditions

We may amend these Terms and Conditions.

The Terms and Conditions in force at the time the order is placed apply to that order.

The most recent version of these Terms and Conditions is always available on our website.

Article 25 – Applicable Law

These Terms and Conditions and agreements between you and Stichting PR 860 Squadron are governed by Dutch law.

If you are a consumer, you always retain the protection granted to you under mandatory consumer law.

Disputes will preferably first be resolved by mutual consultation. If this is not possible, the dispute may be submitted to the competent court in the Netherlands.
